This remodeled 3-Bedroom, 3-Bath penthouse condo awaits your romantic island sojourn or fun-filled family vacation. Makena Surf is one of the few condo resorts where almost all of the units are ocean-front. Our condo is located on a corner as close to the ocean as you can get with jaw-dropping vistas from most of the rooms. At 1640 sf plus two spacious lanais, this home gives you room to spread out and enjoy the amazing ocean-front views.
Our home comfortably sleeps 8 with generous-sized rooms and high ceilings. Two bedrooms have king-size beds, attached bathrooms and doors that open out to a lanai. Imagine not even having to get out of bed to marvel at the ocean view. The sounds of the ocean will lull you to sleep every night. The master bedroom actually has doors leading to two different lanai's. The third bedroom has two single beds and a door to the 3rd bathroom/powder room. Central air-conditioning and a full-sized washer and dryer are included as well as 3 televisions, one with surround sound, DVD players and internet access.
Watch both the ocean and TV from the great room or have a family meal in the 6-seat dining table. Sample the views from one of the lounge chairs on the lanai and try to decide which one is the best! It's a tough life but someone has to lead it. You can also see the ocean from the fully-stocked kitchen in case you decide not to dine in one of the world-class restaurants in nearby Wailea and Kihei. Or you can barbecue and eat on the dining table on the lanai.
If you love looking at the ocean, you will be so happy here that you might not want to leave! You can see whales in the winter and turtles all year around as well as an occasional dolphin. If you really want to leave the condo, there are two world-renowned beaches steps away and several more are a short drive away. Our beach is so awesome that many people pay to be brought here - the tour companies call it "Turtle Town." We have beach chairs, boogie boards and sand toys for your use and you can rent kayaks and snorkel gear near by. Makena Surf has two recently-remodeled pools and hot tubs, tennis courts, and even an herb garden as well as 24 hour security and free parking.

Makena Surf has two recently-remodeled swimming pools and 2 hot tubs, 4 tennis courts with pickleball, an exercise room, an herb garden, 24 hour security and free parking. Makena Surf, Unit #F-302 (“Property”). The condo has 3 bedrooms and 3 full bathrooms: Two bedrooms have a king-size bed, and the third bedroom has two twin beds that can be made up as a king bed when requested in advance. There is also a pull-out couch in the living room. Makena Surf is an oceanfront resort and our condo is located on the third floor in Building F. The Property Is furnished and includes linens, cookware, dishes and eating utensils. There are 27 steps up to the third floor and there is no elevator. F-302 has a keyless door lock and a code will be texted to you after your final payment has been received and this document and the Confirmation letter are signed and returned.
1. CHECK-IN TIME IS AFTER 4 P.M. AND CHECK OUT IS 10 A.M. No early check-ins or late check-outs are permitted unless mutually agreed upon in writing. Staying after check-out time could result in an extra day’s charge. We will consider accommodations if there are no overlapping bookings and if we know at least 2 weeks before check-in. An additional fee may be charged for early check-ins/late check-outs.
2. This is a NON SMOKING unit. At Makena Surf, smoking of legal substances is only permitted at designated smoking areas. A $700 cleaning fee will be deducted from your deposit if there is any evidence of smoking in the unit or on our lanais.
3. PETS: Non-service animals are NOT permitted at Makena Surf. A $500 penalty will be charged if there is evidence of any unauthorized pets on the property or in the condominium. If you want to bring a pet, please provide a letter from a medical professional documenting need as well as pet vaccination documentation.
4. MINIMUM AGE: We cannot rent to anyone under 35 years of age unless accompanied by an adult guardian or parent.
5. DAMAGE – A Security Deposit is required. The deposit is NOT applied toward rent and it is fully refundable within fourteen (14) days of departure. The owners may, at their sole discretion, deduct the following costs from the deposit:
a. Damage to the Property or furnishings including stained linens and carpet;
b. Charges incurred due to contraband, pets or collection of rents or services rendered during the stay or if the renter is evicted by a representative of the owner or by local law enforcement;
c. Missing or broken furniture, furnishings or beach gear;
d. Excessive dirt, sand, or other mess requiring extra cleaning;
e. Evidence of smoke or smoking inside the condo or on the lanais;
f. Early check-in or late check-out unless mutually agreed upon in writing;
g. Violation of any of the resort rules that incur fines or penalties to the owner;
h. Evidence of misuse of Property (i.e. more than 6 guests or using Property for an event) or any other cost incurred by Owner due to Guest’s stay.
6. PAYMENT: A deposit is required at booking. The advance payment (except for the VRBO “Service Fee”) will be applied toward the room rent. The final payment is due 30 days before arrival. A $35 fee will be assessed for any returned checks. Owner is not responsible for refunding booking website fees or any fees your bank may charge.
If you wish to pay by check, please make payments in the form of bank ACH deposit or wire, cashier’s checks or personal checks payable to Susan Heller and mail it to the address listed on the rental confirmation. Checks must arrive on or before the due date. If payments are not received on time or your check is returned by the bank, the reservation may be cancelled and previous payments become non-refundable in compliance with the cancellation policies listed below.
7. CANCELLATIONS: If Guest wishes to cancel their reservation, their payment will be refunded as follows: 100% of payment, less a $250 processing fee, will be refunded if cancelled at least sixty (60) days prior to check-in date. If Guest cancels between 30 and 60 days prior to check-in, they will be refunded 50% of total rent plus taxes. Refer to VRBO for their refund policy of their “Service Fee” if applicable. Cancellations or changes that result in a shortened stay and are made less than 30 days of the arrival date will forfeit the full advance payment. After check-in, there will be no refund of rental fees, cleaning fees or taxes paid.
8. MAXIMUM OCCUPANCY- The maximum number of guests per condominium is limited to 8 persons (any ages; children included). Rate quoted is for 6 guests and an additional charge of $50 per person per night will be assessed for the 7th and 8th guest. Unauthorized extra guests could result in eviction.
9. QUIET TIME: 10 PM until 8 AM is “quiet time” every evening. All noise including loud talking, music and other sounds should be moved indoors during the hours designated as “quiet time.”
10. WATER DANGERS: Guest acknowledges that this home is situated directly on the Pacific Ocean. This large body of water has many inherent dangers associated with it. Guest acknowledges that management and owner are not responsible for any accidents or injuries arising from use of the beach, ocean, swimming pools or hot tubs. Guest assumes all responsibility to ensure their guests are safe. Guests will use owner-supplied beach gear (boogie board, etc.) or items left by prior guests at their own risk and indemnify and hold harmless the owner, manager and Homeowner’s Association if any harm occurs from usage of said items.
11. NO DAILY HOUSEKEEPING SERVICE: While extra linens and bath towels are included in the unit, daily housekeeping service is not included in the rental rate. Mid-stay cleanings are available for an additional cost.
12. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in or may be evicted. The person signing this contract must be present during the entire rental period and is at least 35 years of age (no form of sublet is allowed).
13. NO EVENTS of any kind are allowed on the property. This is a HOME in a residential neighborhood and is NOT a hotel or an event center. Guest agrees to NOT have any type of event at the house, including (but not limited to) wedding, shower, bachelor/bachelorette party, cocktail party, or ANY OTHER PARTY.
14. WRITTEN EXCEPTIONS: Any exceptions to the above-mentioned policies must be approved in writing in advance.
15. PARKING/ PARKING PASSES: Parking is limited to two (2) vehicles and gate cards will be provided. Renters must register their vehicles and display parking pass on the rear-view mirror at all times. Failure to display may result in towing of vehicle at renter’s expense. Parking spots are first come, first served.
17. HURRICANE OR STORM POLICY: No refunds for storms will be given and we highly recommend you purchase travel insurance. Hurricane season is from June 1 through November 30.
18. THE CONDO WILL BE CLEAN AND IN WORKING CONDITION; however, no compensation will be given for non-working items outside the owner’s control, including but not limited to power outages, cable TV and internet outages, appliance problems etc. For items inside the owner’s control, the owners will make every attempt to rectify problems that may occur while you are in the condo. It is the renter’s responsibility to notify the owner or on-island contact immediately if there are any problems. No refunds or any other compensation will be given for the problems that the owner is able to rectify within a reasonable time frame.
19. The condo is privately owned; the Owners and the Homeowners Association are not responsible for any accidents, injuries, illness, loss of personal belongings or valuables that occurs while on the premises or using its facilities. By accepting this reservation, it is agreed that all guest are expressly assuming the risk of any harm arising from their use of the premises or their guests whom they invite to use the premise.
20. KEYLESS ENTRY SYSTEM: Guest’s personal access code shall only be enabled for the timeframe of the stay as prescribed in the Confirmation Agreement. Guest understands that the door will be locked, and the access code disabled at the time this Agreement ends and Landlord is not required to allow Guest or additional persons access into the condo once the code is disabled.
21. ENTRANCE AREAS OF PROPERTY UNDER VIDEO SURVEILLANCE: Guest agrees that the entrance to the Property is not private and may be under 24-hour video surveillance for the sole and exclusive benefit of the owner. Guest acknowledges that Owner and its agents and employees may monitor the video surveillance at any time for any reason, including but not limited to Guest’s and additional persons’ compliance with the terms of this Agreement. Guest shall advise all persons in their party regarding the video surveillance.
22. OCCUPANCY TAXES: Owner will remit Hawaii State AND Maui County Transitory Accommodation & General Excise taxes collected, as outlined in the rental confirmation letter, to the State under account #’s GE/TA-153-177-7024-01 and MC. Owner agrees to remit taxes month after deposit is received.
NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property do not assume liability for the loss, theft, damage or injury (or death) to persons or their personal property. Guests agree to indemnify and hold the owners and managers harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests’ use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss.
The undersigned guest agrees that all rental monies are non-refundable per the cancellation policy. The undersigned has reviewed their right to purchase travel insurance. They also agree charges can be taken out of the security deposit if damages are incurred during the stay. By signing below, the undersigned and their entire party agree to all terms and conditions of this agreement.

Release of Liability
Guests are granted access to Rental Property and many of amenities that exist within the property. To the fullest extent permitted by law, the Guests agree to use any personal and real property belonging to the Homeowner at their own risk and agree to release Homeowner of all liability associated with using such property. Homeowner cannot be held responsible or liable for injuries that occur while Guest is in possession or use of property. Guests agree to further to take on any liability associated with a third-party guest visiting the Rental Property or use of the Homeowner's property. Homeowner does not permit use of any of Homeowner's Property other than by the Guest and hereby disclaims any claims of liability associated with the Rental Property or property within and around the rental unit.
